Darrin Roth from Bayside, Wisconsin, has filed a lawsuit against Delta Air Lines claiming he was knocked unconscious during landing when his seatbelt failed. He was traveling with his wife, Geralyn, from Tampa, Florida, to New York City but had to be taken off the plane by stretcher to a hospital in Queens, The Milwaukee Journal Sentinel reported.
Flight attendants inspected the seatbelt immediately after the mishap and found signs of malfunction. In the weeks that followed the accident in January 2025, Roth experienced a heart attack, which led to a quadruple bypass surgery. He also endured a cervical fusion operation in November 2025, all of which Roth has alleged is derived from the accident.
Knocked Out Cold By Technical Difficulties In The Cabin
Roth claims the seatbelt “failed” upon landing in NYC, throwing him into the bulkhead. The impact caused him to instantly lose consciousness. He claims it is Delta’s responsibility due to negligent maintenance of equipment. The couple is seeking compensation of an unspecified amount. The case litigation remains pending at this time.
New York is a no-fault state. However, this accident involved a commercial airline flight governed by federal aviation standards and common carrier law. Thus, the New York no-fault rules may not apply. The fact that the seatbelt failed during a routine landing, and that FAs actively observed problems with the seat, provides evidence of a breach of duty.
Under the legal doctrine of res ipsa loquitur, seatbelts should not fail during ordinary operations for which they were designed. In the lawsuit filed by the Roths, Milwaukee attorney Thadd J. Llaurado stated that the FAs aboard his client’s plane acknowledge the seatbelt was dysfunctional in these words, as recounted by the Milwaukee Journal Sentinel:
“[The device] may have been installed incorrectly or twisted.”
The Eggshell Skull Case Against Delta Air Lines
While Delta’s liability for the initial impact appears clear, the major legal battle will focus on the scope of the medical compensation. Airlines almost always prefer to settle clear-cut equipment failure cases out of court to avoid public trials. Although it is probable the Roths will be compensated for the immediate injury treatment in NYC, Delta’s defense attorneys will likely argue that the heart attack and spinal issues were due to pre-existing conditions.
If fault is established, the Roths may be able to pursue more damages under the so-called ‘Eggshell Skull Rule.’ Also called the ‘thin skull rule,’ this is a legal doctrine in tort and criminal law stating that a wrongdoer must take their victim as they find them. If a person has a hidden physical or mental vulnerability, the defendant generally remains fully liable for all resulting harm, even if it is much worse than expected.
In highly contentious cases where trauma causes a delayed medical event, the case entirely boils down to medical expert testimony and the plaintiff’s before-and-after medical records. Yet, the vast majority of clear negligence aviation cases involving pre-existing conditions end in private settlements.
The Curious Case Of Delta’s Defective Lap Belt
Among the various mechanical possibilities that could have led to Roth’s injury, a failure of the mechanism is most improbable. On the other hand, negligent work by maintainers is a very real, albeit also unlikely possibility. Like all components on commercial airliners, every part is strictly controlled and repaired or replaced on clear schedules. If one were left in use too long, however, it is possible the internal springs and cams that lock the belt could have slipped instead of locking upon touchdown.
Aircraft seatbelts are attached to the seat frame via heavy-duty metal anchor shackles. If a maintenance technician inverted the left and right sides or attached the belt assembly facing the wrong direction during standard cleaning or seat refurbishment, the webbing would be misrouted. Under the sudden deceleration forces of landing, an incorrectly positioned anchor can prevent the restraint from locking under pressure.
When the thick nylon or polyester webbing of an aviation seatbelt is severely twisted inside the adjustment buckle, it alters the friction dynamic. So the twisted belt observed by the crew could mean that the restraint was unable to perform as designed. When the plane touched down and forced Roth forward, the extreme load likely caused the twisted fabric to slide straight through the buckle mechanism rather than locking, letting the belt slacken instead of tighten.
